How about when you death attack someone, something along the lines of:
Level 10 Assassin - 5% vulnerability to Slash and Pierce Damage for a pre-determined number of rounds?
Level 20 Assassin 10% vulnerabilty ....
Level 30 Assassin 15% vulnerability ....
Perhaps as a further bonus a death attack from a Level 30 Assassin could cause similar effect as the Crippling Strike feat?
Each successful DA lowers con by 2, 4, or 6 for X rounds, scaled by the level breaks 10, 20, 30. Stacks indefinately or to a max equal to sin levels. Requires grestore to remove (not lesser like cripple).

My understanding is that we are making suggestions for the death attack (currently paralyze) not for the vial of insta-death. Personally, if we remove the para effect, it kills the entire basis of my main assassin and her ranged attack focus. But if everyone is going to be immune to it, i'm just throwing out other ideas, as i think of them, then seeing what others think about it.
My thought behind my most recent suggestion is to try to improve the chances of the vial of death by reducing fort saves with the DA. I don't think it's an ideal solution (i like para effect!) But at least it can allow a focused assassin to insta-kill everything if you can get a few DA's in to reduce fort. Dropping fort saves by 20-30 should make for a long and careful assault resulting in even a CoT's failure of the vial save.

Then perhaps death attack should be re-worked entirely and not attached to sneak attacks, but more like Smite with x number of per day and does X damage based on how many Assassin levels the build has and INT mod. And so not the same as Smite ... add minus and positive based on victums alignment (minus for evil (domain of Smite), slight bonus on neutral, and larger bonus against good aligned, bonus to Lawful, and minus to chaotic.)

Dropping saves by 20-30? Might as well insta kill without any save allowed. As it is right now assassin isn't helpless in 1 on 1. With that kind of ability it would be unstoppable in those situations.
I can understand that SL is unsatisfied by assassin since it is not as useful in group pvp and is a bit hard to use. But this would improve it more on its current strengths then fix the weaknesses.

Dropping con would kill the HP faster than the fort save BTW. To drop 20-30 fort save is dropping 40-60 con. Cripple + Sin levels would be crazy powerful. Sin + Sorc/Wiz (PWK) would run rampant... just knock up a few DA and then PWK away!
