Powerful items with drawbacks

If level cap is currently 25, why would there yet be any uber epic items?
And as if such start to drop on epic areas it seems logical when those are done, but doesnt those drawbacks basically just add possible to get even stronger weapons than you could have on that current level, i mean if you had sword with -10 str and lvl req 10 couldnt you then put over 10 level of req positive effects on it. So this drawback stand just so some can get totally uberness weapons?
