Move Silently / Listen checks seem to negate Hide.

I know this is probably a burnt cause but I will post it here. In testing of my ability to hide with someone who only has listen skills I found something that is interesting to me. It seems that weather or not you move the move silently vs. listen checks still check at regular intervals, So Hide in itself turns useless. It also is a fact that the listener gets an advantage of +5 points if he is standing still (apparently cause its easier for him to listen when he himself is being quieter, at the same time there is no adjustment for the one who is hideing and standing still) In the wording itself should move silently checks be done while moveing? and if not shouldn't there be a bonus to the move silently check when your not moving? I have a 109 hide due to my "Special ability" 30 points which mean nothing cause maxed out my move silently will never go much above a 70. My friend who has no spot but a 60 listen was able to spot me quite often after the HiPS. Please help me understand the reasoning here, cause I really though that +30 points would help me hide.
