I haven't tried testing this out at all yet, but since the original owner of an item is supposedly tracked through thefts and such, if I make a trade with another player then kill that player would I get my items back?

Yes, I believe one of the DEVs said so in another post. That is, you can get back any items stolen from you (via pick pocket) no matter who carries them. Just trading items is not considered theft, i.e. it's not tracked that the item once belonged to you.
Another question to the devs: If A has an item, then B steals it from A, and then C steals it from B. When B hunts down C and kills him, would he get the item back, as he's not the original owner? Similarly, if A kills C would A get the item back?
