Whoa, the AI automatically knows your ranks in discipline/concentration/spellcraft?
ok... is it just me or does this make absolutely no sense? there is no way you can tell how skilled someone is with a weapon, how good they are at keeping concentration, or how knowledgable they are just by looking at them... it doesnt make any sense how the enemies would just know how skilled you are.

Because there isn't a way for the AI to know that your disc is too high for them to disarm you otherwise. I don't think they can track failed disarm attempts intelligently like people can.

For the first few seconds it might be unfair, but I imagine that's the only way to make the AI react to your character's skill. In PvP you'd pick up on your opponents talents quickly by seeing what happens when you attack them. This is basically a scripted way of doing that.
With regard to the item tracking: it's tied to the original owner, not the thief. If you die with any stolen items in your inventory that originally belonged to your killer, you will drop them.
Open Lock: Widely Implemented. Few unlockable locked doors exist, however a great number of randomly spawning chests will be locked.
This seems to imply but not say that these random spawning chests will be non-bashable....or did I read something into it that wasnt ment?

theoretically, couldnt the AI be told not to take the character skill levels into account for the first couple of rounds, and then to adapt?
