If memorie serves well the dire bear was set to outsider by the devs.
This because the DC of Animal Empathy is hardcoded in the engine, at the values of 20 for non hostile animals and 30 for hostiles. it was done to prevent verry low lvl druids and rangers to take the dire bear as pet.

I did not even know that that was what killed the spawn.
if some one is ressed than there wont be a problem?
